Terms of Service

1. Acceptance

By installing, creating an account, or using this application, you agree to these Terms of Service. If you do not agree, do not use the application.

2. Service Description

Melixa is a paid SaaS mobile application providing:

• Hive and beekeeping data management
• AI-assisted analysis and insights
• Cloud-based data storage and synchronization

3. Membership and Fees

The application operates on a paid subscription model. Subscription fees cover:

• Cloud Firestore database storage and operations
• AI API usage costs (e.g., Google Gemini, Anthropic Claude)
• Server and infrastructure expenses
• Development and maintenance costs

By subscribing, you agree to share these operational costs.

4. Payments and Refunds

• Subscriptions are managed through Apple App Store or Google Play Store
• Refunds for unused periods are not guaranteed
• Service interruptions do not automatically qualify for refunds
• Third-party payment provider rules apply

5. AI Usage and Third-Party Data Sharing

AI features in this application are powered by third-party AI service providers:

• Anthropic (Claude AI) - Privacy Policy
• Google (Gemini AI) - Privacy Policy

When you use AI features, the following data may be transmitted to AI providers:

• Hive inspection data (observations, measurements, notes)
• Hive information (type, status, queen details)
• Approximate location (for seasonal accuracy in recommendations)
• Historical inspection trends (up to 3 recent inspections)

• AI outputs are provided for informational purposes only
• AI outputs are NOT guaranteed to be accurate or complete
• AI outputs are generated by automated third-party systems
• AI outputs do NOT constitute professional beekeeping, veterinary, or agricultural advice
• AI systems may contain errors or misinterpret context

IMPORTANT: AI outputs should never be the sole basis for critical decisions. Users must verify all recommendations independently.

6. AI Data Consent

By using AI features in this application, you consent to:

• Your beekeeping data being transmitted to third-party AI providers
• Data being processed according to each provider's privacy policies
• Receiving AI-generated recommendations based on your data

• You can disable AI features at any time through Settings
• "Seasonal Tips" toggle - controls AI-powered seasonal recommendations
• "AI Insights After Save" toggle - controls post-inspection AI analysis
• When both toggles are disabled, NO data is sent to AI providers

You may revoke this consent at any time by disabling AI features in Settings.

7. User Responsibility

By using this application, you acknowledge and agree that:

• You are an experienced beekeeper capable of independent judgment
• All final decisions regarding your beekeeping operations are YOUR responsibility
• Field implementation of any suggestions is at YOUR own risk
• The application does not replace professional expertise or on-site assessment

8. Disclaimer of Liability

The developer is NOT liable for any direct, indirect, incidental, or consequential damages, including but not limited to:

• Colony losses or bee mortality
• Honey production losses
• Disease management errors or pest damage
• Operational or strategic decision errors
• Financial losses or lost profits
• Any outcomes resulting from AI recommendations

THE APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

9. Service Availability

The application depends on third-party cloud and AI services. The developer is not responsible for:

• Service interruptions or downtime
• Data access issues
• API failures or slowdowns
• Performance degradation
• Temporary or permanent service discontinuation

No uptime guarantee is provided.

10. User Data and Content

• Users are responsible for the accuracy and legality of data they enter
• Users may not upload harmful, illegal, or malicious content
• The developer does not verify or validate user-entered data

11. Account Termination

The developer may suspend or terminate accounts for:

• Terms violations
• Abuse or excessive cost generation
• Security risks
• API abuse
• Any behavior that harms the service or other users

12. Service Modifications

The developer reserves the right to:

• Modify, add, or remove features
• Change AI service providers
• Update pricing with reasonable notice
• Suspend or discontinue the service

13. Intellectual Property

The application, including its design, code, and branding, is owned by the developer. Users retain ownership of their beekeeping data.

14. Force Majeure

The developer is not liable for failures caused by events beyond reasonable control, including natural disasters, war, pandemic, government actions, or infrastructure failures.

15. Governing Law

These terms are governed by the laws of the Republic of Turkey. Any disputes shall be resolved in Turkish courts.

16. Limitation of Liability

IN NO EVENT SHALL THE DEVELOPER'S TOTAL LIABILITY EXCEED THE SUBSCRIPTION FEES PAID BY THE USER IN THE PRECEDING 30 DAYS.

17. Updates

These terms may be updated at any time. Continued use after updates constitutes acceptance of the new terms. Material changes will be communicated through the application.
